This
paper first gives a brief history of the "Miranda vs. Arizona" landmark case in which the Supreme Court ruled that,
upon arrest, a defendant must be informed of certain constitutionally protected rights. The
paper then discusses the significance of "Dickerson vs. United States," a case that challenged the Miranda ruling. This is followed by a discussion of the positive and negative impacts the Miranda rule has had on the criminal
justice system, as well as the author's own arguments that pre-Miranda rule on the issue would cause more harm than good and would place a considerable burden on the justice system.
