Treaty A.C.T.A. fully break the Romanian Constitution and this seems to be often overlooked, as demonstrated by a study by the Legal Department of truth.
In this article are placed in front of the Romanian Constitution and ACTA Treaty highlighting nearly all the contradictions that arise. And as an example:
In article 11 of the Treaty are provided the following:
"Without prejudice to its law regulating the privileges, protection of confidential sources of information or processing of personal data, either party provides that in civil judicial proceedings concerning the application of intellectual property rights, its judicial authorities have the authority to request justified the right holder, order the offender real or possibly supposed offender, to provide the right holder or judicial authorities, at least in order to gather evidence, relevant information, as provided in laws, regulations and administrative rules applicable the real or perceived offender owns or controls them. Such information may include information on any person involved in any aspect of the violation, real or perceived and the means of production and distribution channels of goods or services concerned, including the identification of third parties which are supposed to be involved in the production and distribution of such goods or services and their distribution channels "
Provisions of the Romanian Constitution and contrary to Article 24 and 26 which reads:
- The right to defense is guaranteed
- Throughout the trial, parties are entitled to be assisted by a lawyer, elected or ex officio
- Public authorities respect and protect the intimate, family and private
- Public person is allowed to dispose of herself, if not violate rights and freedoms of others, public order or morals.
