With the payment of rent the lease will be considered. The tenant is bound to pay regularly to the landlord
while enjoying the property of the owner, as per agreement. The amount if not paid will be deemed as direct
violation of contract made and would lead to forfeiture of lease itself. The forfeiture will reject the lessor’s title by lessee and bankruptcy by tenant. If penalty is issued then lessor may re-enter by evicting the lessee. The court has provided relief in such cases under section 114 and 114A of Transfer of Property Act. This Act provides power to the court to give relief to the tenant who was due to pay the rents, provided he makes the payment of rent with full interest and cost to the landlord. Though the landlord may seek
eviction of the tenant, the court might consider the tenants readiness to pay the rent along-with the other costs compensating the landlord. The tenant could be continued in the premises by not granting the relief asked for by the landlord.
