F: Petitioners brought suit alleging that General Fabian Ver had ordered the Task Force Makabansa of the AFP to conduct "preemptive strikes against known communist terrorists'' underground houses" in Metro Manila. The TFM raided some places using defective
warrants; they seized personal belongings of petitioners; they had been interrogated in violation of their right to silence and to counsel; they had been tortured and intimidated. Petitioners asked for payment of damages for violations of their constitutional rights. HELD: The
suspension of the privilege of the writ of habeas corpus does not destroy petitioners'' right and cause of action for damages for illegal arrest and detention.
