Law and Morality
At a soft voice I got a note on how things work and how things can be worked out.It got me to think of something to begin with.Thought it to be the law.I looked at it both the ways - locally and globally and hence found out something about the law as a whole and as on a particular issue.While I struggled to answer the perfection of this body of the constitution,I had already nexused the terrible conditions prevalant in it with something more unusual to get highlighted.I gave a Thought to the 'Inner Nature Of The Law'.The idea was to clear one small doubt.Is it that whatever is lawful is moral or is it that whatever is morally correct becomes lawful?But this seriously required a real analystic approach.
I wondered and enquired further, and finally came out with some interpretations on ' what the law is ' and ' what the law ought to be '.It was nice to hear such a philosophical difference but to linger over it was really tough.So I thought and came out with some ideas to reach my goal.Morality said that everything is relative and this was a big problem to an exact scenario.Law said it had nothing to do with emotional aspects no matter howwell the nervous system of animals were defined.But both had something in common and that was belief.What rubbish I thought;if this were the way the things meant to go on then it would be like white people as minority ruling the blacks that were the majority.
I was shocked and promised myself to gather more out of the fuzzy logic.Then I found something that there was something apart from morality that law needed to be connected.And that was its Inner nature.It was like people fighting but still feeding their stomachs in common.If I said thatevery child's education is mandatory by law then it did not imply that I have to teach my child in school only.It is a law to educate but not to educate only in schools.Then why is it that I can't allow my children to study at home.Only because my certificates and approval certificate of my marks are in the hands of the Central Board that is profit based.Teaching in schools does solve the problem in schools but at the same time reduces the efficiency of the education system ,thereby declining the level of education.Still there exists a local problem but globally it seems an exchange of energy in the form of money. Anyways then I came upon the more dominant factor of law related anywhere to morality as it simply did not imply the perception extent of any individual in framing conventional laws.Some laws in the form of inner nature like safety and healthy living rules are a part of day to day life.There is a difference between what you need and what you want.Morality is the need and Justice is the want.Justice without laws is like an aeroplane without flying engines.The justice and morality are like a mother and her child.You never know when the mother turns greedy or the child gets nasty.Law on the other hand was enjoying the commanding background.A pope can teach you good and damn you but the law,once decided,can kill you.So the fame and name is in the morality but the game is the law.
Human nature was really moral because of one's experience and rational insight but now the crab mentality has given birth to competition.Morality has a choice now -- either it chooses another road or modifies the same road.But the problem is there is no destination.The Law gives no end to what is and what its ought to be.And this leads to a complex state where I submit to my real state as a normal human being who once did but now,sees and does.The process of making is greater than the state of being.Hence its too late to mould the law as per moral grounds but only thing we can expect out of the law is to judge uniformly and not blindly by following the criterion "Innocent till Guilty"...
